Party Wall & Neighbourly Matters
Where construction work is occurring astride boundary line, on shared or 'Party' walls and excavation is being undertaken next to neighbouring property, the works are likely to be subject of the Party Wall etc act 1996.
The Act can give rights to the developing owner, and offers protection to their neighbouring owner, provided both parties abide by the Act.
It is vital that anyone who wishes to undertake building work familiarises themselves with the Party Wall etc Act 1996 as works can be stopped on site until the Act is adhered to, resulting in delay and possibly financial loss.
The purpose of the Party Wall etc Act 1996 is to provide a procedure for an owner wishing to carry out works to walls or floors or excavations, to make their neighbour of their intentions.
Where a dispute arises each party has the right to appoint a surveyor to represent their interests and one of the duties of the Party Wall surveyor is to agree an Award document and where necessary for each of the owners to retain as a reference point during the course of the work.
ATP Group are able to provide professional expertise to private clients, developers and contractors in relation to party wall and neighbourly matters.
